The ruling came after three criminal defendants challenged Habba’s appointment. These are people facing federal charges who don’t want Trump’s people prosecuting them. They found a friendly Obama judge willing to do their dirty work.
Judge Brann claimed Habba has been serving without authority since July 1st. He said the Trump administration used improper methods to keep her in the job. But Trump won the election and has every right to put his own team in place.
The judge wrote a 77-page order attacking how Trump staffed the position. He complained about the administration’s personnel moves and called them unlawful. This is just another example of activist judges trying to stop Trump from doing his job.
Brann disqualified Habba from participating in ongoing cases. He said she cannot supervise prosecutions of the three defendants who challenged her. The criminals get their way while Trump’s appointee gets sidelined.
The ruling follows weeks of legal battles over Habba’s appointment. Federal judges have been fighting the Trump administration over who should run the prosecutor’s office. They want to keep their own people in power instead of letting Trump pick his team.
