The Obama administration's Deferred Action for Childhood Arrivals (DACA) policy was found to be in violation of United States immigration law by a three-judge panel of the 5th Circuit Court of Appeals just yesterday (Wednesday the 6th). This ruling affirms the decision made by a federal judge in Texas in July 2021 who prohibited Team Biden from enrolling even more illegal immigrants in the program.
Specifically, the court came to the conclusion that the Obama administration lacked the legal power to establish the program in 2012 when it did so because of the ruling it issued.
The life of Dreamers is still uncertain, but the court's stay gives a short relief for them, Biden stated in response to the verdict. Permanent protections, including a path to citizenship, for Dreamers should be passed by Congress immediately.
However, despite the fact that the 5th Circuit court upheld Judge Andrew Hanen's ruling from 2021, a ruling that bars Vice President Biden from enrolling even more illegals in the program that has been around for a decade, the panel did not go so far as to fully dismantle the program.
Instead, new illegal immigrants will not be permitted to participate in the DACA program, but the program will continue operating normally for the beneficiaries who are already participating in it, and DACA will be permitted to continue processing the beneficiaries' renewal applications.
The previous administration of Donald Trump made an effort to terminate the Deferred Action for Childhood Arrivals (DACA) program, but the Supreme Court blocked their efforts.
